Terms and Conditions

1. Who we are
The website houseofgonia.com (the “Website”) is operated by ASAP HUB SRL, a limited liability company registered in Romania, with its registered office at Păuleștii Noi 118A2, Prahova County, Romania, Trade Register no. J29/1261/2017, tax identification code RO37666394, trading as House of Gonia (“House of Gonia”, “we”, “us”).

These Terms apply to the use of the Website and to every order placed through it or agreed with us afterwards by email or phone. Please read them before sending an order request. If you are a consumer, nothing in these Terms limits the rights you have under the law.
2. Our pieces
Every piece is handcrafted in our Bucharest studio in 925 sterling silver and, where stated, with gemstones, freshwater pearls or natural fragments. Because they are made by hand, pieces may differ slightly from the photographs; these variations are part of their nature and are not defects. Colours may also look different depending on your screen.
Most pieces are made to order once your order is confirmed. Unless the product description says otherwise, production and shipping take 10–15 working days. Pieces from Study of a Pearl — Aphros are one of a kind and are sold as they are.
Prices are shown in euro (EUR) and include VAT. Delivery is not included; its cost is communicated to you before your order is confirmed. For customizable pieces the price shown is an estimate, and the final price is agreed with you before confirmation.
3. How an order works
A. Order request
Adding pieces to the bag and pressing SEND ORDER REQUEST sends us an order request. It does not oblige you to pay and does not yet form a contract. You will receive an automatic email confirming that we received your request; that email is not an acceptance of the order.
B. Confirmation
We contact you by email or phone, usually within 2 working days, to confirm availability, size and options, the final price, the delivery cost and time, and the payment method. The contract between you and House of Gonia is concluded only when we both confirm the order in writing, by email, after this conversation.
We may decline an order request at no cost to you, for example if a piece is no longer available, if a price or description on the Website contains an obvious error, or if we have reason to believe the request is not genuine.
C. Payment
Payment is made by the method agreed when the order is confirmed, for example bank transfer. We do not collect card or payment details through the Website. Work on a made-to-order piece starts once the payment agreed at confirmation is received.
D. Delivery
We deliver by courier to the address you give us, in Romania and abroad; the delivery time and cost are confirmed with the order. For deliveries outside the European Union, customs duties and import taxes may apply and are paid by the recipient.
Please check the parcel when it arrives and tell us within 48 hours if it is damaged or incomplete. Ownership of and risk for the piece pass to you when it is delivered.
4. Right of withdrawal
If you are a consumer, you may withdraw from the contract within 14 days from the day you, or a person you designate, receive the piece, without giving any reason, under Government Emergency Ordinance no. 34/2014.
To withdraw, send us a clear statement by email to office@houseofgonia.com before the 14 days end. You may use the model form below, but you do not have to. Return the piece unworn and in its original packaging within 14 days from telling us, to the address we give you; the direct cost of returning it is yours.
We refund all payments received from you, including the standard delivery cost, within 14 days from the day we receive your withdrawal, using the same payment method unless we agree otherwise. We may wait with the refund until we receive the piece back or proof that you have sent it. You are responsible for any loss in value caused by handling the piece beyond what is necessary to establish its nature and characteristics.
Under article 16 letter c) of Ordinance no. 34/2014, the right of withdrawal does not apply to pieces made to your specifications or clearly personalised: custom pieces, pieces with a stone, finish or size chosen outside the options listed on the Website, engraved pieces and pieces resized at your request. We tell you if this applies before your order is confirmed.

5. Guarantee of conformity
As a consumer you benefit from the legal guarantee of conformity for 2 years from delivery, under Government Emergency Ordinance no. 140/2021. If a piece is not in conformity, you may ask us to repair or replace it or, where that is not possible, for a price reduction or a refund.
Natural wear, scratches from use, the natural darkening of silver (which can be cleaned) and damage caused by accidents or improper care are not a lack of conformity. After the guarantee we still offer cleaning, polishing, resizing and repairs; ask us for details.
6. Custom orders
For custom pieces we agree the design, materials, size, price and timing with you in writing before we start, and we may ask for an advance payment. Once work has started, a custom order can be cancelled by agreement, and the advance covers the work already done.
7. Use of the Website and intellectual property
All content on the Website, including the House of Gonia name and logo, the designs, photographs, films and texts, belongs to House of Gonia or its partners and is protected by intellectual property law. You may view and share it for personal, non-commercial purposes; any other use, including copying, reproducing or publishing it elsewhere, requires our prior written consent.
You agree not to use the Website for unlawful purposes or in a way that could damage it or its users. We take care to keep the Website available and accurate, but cannot guarantee that it is always available or free of errors.
8. Liability
We are responsible for the pieces we sell as provided by law. We are not liable for losses that were not foreseeable when the contract was concluded, or for indirect losses, except where the law does not allow such a limitation. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded by law.
9. Personal data
We process the data you send us as described in our Privacy Policy.
10. Complaints and disputes
Please write to us first at office@houseofgonia.com; we answer complaints within 30 days. If we cannot resolve a complaint together, consumers can turn to the National Authority for Consumer Protection (ANPC) or to alternative dispute resolution (SAL).
These Terms are governed by Romanian law. Disputes that cannot be settled amicably are decided by the competent Romanian courts. If you are a consumer, you keep the protection of the mandatory rules of the country where you live and may also bring a claim there.
11. Changes
We may update these Terms. The version that applies to an order is the one published when you sent the order request.
